General Terms and Conditions of Sale

1. Applicable scope
The General Terms and Conditions of Sale (referred to below as the “GTCS”) are applicable to all legal transactions which are concluded online (www.watchexplorer.swiss), in the reception offices and on the basis of a telephone reservation and which are offered by Watch Explorer, a trademark owned by Neuchâtel Tourism (Tourisme neuchâtelois), a Swiss association having its registered office at: Hôtel des Postes, 2001 Neuchâtel, Switzerland (referred to below as “TN”).
2. Conclusion of contract
2.1. General
Every order / purchase / reservation placed or made on the www.watchexplorer.swiss website, in the reception offices or by telephone is deemed to constitute acceptance of these GTCS and is confirmed in writing. The contracting party undertakes to provide valid contact/personal information when placing the order, and to pay the requested price in case of payment on invoice or in cash. Payment must be made no later than 24 hours before the date of the service you have reserved. Failure to pay within this period will result in cancellation of the reservation.
2.2. Prices
Prices are shown in Swiss francs (CHF), inclusive of VAT.
2.3. Payment methods
Payment can be made via the internet using PayPal, and in TN’s reception offices using debit cards, credit cards, cash and on invoice.
2.4. Gift vouchers
Gift vouchers are valid for two years after their date of issue. They cannot be reimbursed.
3. Special terms and conditions
3.1. Visit to the Zenith Manufacture
Site of the Manufacture: the visit involves moving between several locations inside the Manufacture and is not suitable for persons with limited mobility.
Late arrival: the visit starts at precisely 9.00 am. Persons arriving late will no longer be able to join the visit that is already in progress.
Cancellation: up to 48 hours in advance: no charge; less than 48 hours in advance: the total price must be paid.
Unforeseen events: any unexpected event related to the organisation and internal operation of the company may result in the cancellation and reimbursement of the visit.
3.2. Visit to the Corum Manufacture
Late arrival: the visit starts at precisely 9.30 am. Persons arriving late will no longer be able to join the visit that is already in progress.
Cancellation: up to 48 hours in advance: no charge; less than 48 hours in advance: the total price must be paid.
Unforeseen events: any unexpected event related to the organisation and internal operation of the company may result in the cancellation and reimbursement of the visit.
3.3. Visit to the Panerai Manufacture
Site of the Manufacture: the visit involves moving between several locations inside the Manufacture and is not suitable for persons with limited mobility.
Late arrival: the visit starts at precisely 9.00 am. Persons arriving late will no longer be able to join the visit that is already in progress.
Cancellation: up to 48 hours in advance: no charge; less than 48 hours in advance: the total price must be paid.
Unforeseen events: any unexpected event related to the organisation and internal operation of the company may result in the cancellation and reimbursement of the visit.
3.4. Visit to the Carillon d’Or
Cancellation: up to 48 hours in advance: no charge; up to 24 hours in advance: 50% of the payable price; less than 24 hours in advance: the total price must be paid.
Modifications: any modification to the details of the visit (timings, number of persons, etc.) must be communicated to TN as soon as possible. Consideration will then be given to the modification subject to the availability of the workshop.
Delayed arrival of the group: in case of delayed arrival, it is essential for the customer to warn TN by calling +41 32 889 68 95. Outside of TN’s opening hours only, the following number should be called: +41 32 731 74 62. The workshop organiser will continue to wait for the group for the first quarter of an hour following the time of the appointment. If the customer is late, the time of the visit will be reduced by a period proportionate to the accumulated delay. If the customer wishes to carry on with the full duration of the visit (subject to the availability of the workshop), he/she must pay an additional inclusive charge.
3.5. Le Centre Horloger
3.5.1. Activity: assembly of a watch
Payment: payment must be made in advance at least one week before the date of the workshop.
Cancellation: up to 7 days in advance: no cancellation charge; up to 24 hours in advance: cancellation charge of CHF 250.00 per person; in case of no-show by the group or cancellation less than 24 hours in advance: payment of 50% of the total per person.
Delayed arrival of the group: in case of late arrival, it is essential for the participants to notify TN by calling the following number: +41 79 765 14 66. The workshop organiser will wait for the participants to arrive for a maximum of 15 minutes after the arranged meeting time for the start of the workshop. If the accumulated delay causes the normal duration of the workshop to be exceeded so that the assembly of the participant’s watch can be completed, and depending on the availability of the workshop, TN reserves the right to invoice an additional inclusive charge.
3.5.2. Activity: introductory course
Cancellation: up to 48 hours in advance: no charge; up to 24 hours in advance: 50% of the payable price; less than 24 hours in advance: the total price must be paid.
Modifications: any modification to the details of the introductory course (timings, number of persons, etc.) must be communicated to TN as soon as possible. Consideration will then be given to the modification subject to the availability of the workshop.
Delayed arrival of group: in case of delayed arrival, it is essential for the customer to warn TN. If the customer wishes to carry on with the introductory course (subject to the availability of the workshop), he/she must pay an additional inclusive charge.
3.6. Enamelling workshop
Payment: the reservation must be guaranteed by a credit card and payment must be made prior to participation in the workshop.
Cancellation: up to 48 hours in advance: no charge; up to 24 hours in advance: 50% of the payable price; less than 24 hours in advance: the total price must be paid.
Modifications: any modification to the details of the visit (timings, number of persons, etc.) must be communicated to TN as soon as possible. Consideration will then be given to the modification subject to the availability of the enamelling workshop.
Delayed arrival of the group: in case of delayed arrival, it is essential for the customer to warn TN by calling +41 32 889 68 95. Outside of TN’s opening hours only, the following number should be called: +41 78 641 40 43. The workshop organiser will continue to wait for the group for the first quarter of an hour following the time of the appointment. If the customer is late, the time of the visit will be reduced by a period proportionate to the accumulated delay.
3.7. The apprentices of time
3.7.1. Activity: watch assembly
Payment: payment must be made in advance, at least one week before the date of the workshop.
Cancellation: up to 7 days in advance: no cancellation charge; up to 24 hours in advance: cancellation charge of CHF 250.00 per person; in case of no-show by the group or cancellation less than 24 hours in advance: payment of 50% of the total per person.
Delayed arrival of the group: in case of late arrival, it is essential for the participants to notify TN by calling the following number: +41 32 930 09 26. The trainer will wait for the participants to arrive for a maximum of 15 minutes after the arranged meeting time for the start of the workshop. If the accumulated delay causes the normal duration of the workshop to be exceeded so that the assembly of the participant’s watch can be completed, TN reserves the right to invoice an additional inclusive charge.
3.7.2. Activity: introductory course
Cancellation: up to 48 hours in advance: no charge; up to 24 hours in advance: 50% of the payable price; less than 24 hours in advance: the total price must be paid.
Modifications: any modification relating to the introductory course (timings, number of persons, etc.) must be communicated to TN as soon as possible. Consideration will then be given to the modification subject to the availability of the workshop.
Delayed arrival of group: in case of delayed arrival, it is essential for the customer to warn TN. If the customer wishes to carry on with the introductory course (subject to the availability of the workshop), he/she must pay an additional inclusive charge.
3.8. Maison Duplain
Cancellation: up to 48 hours in advance: no charge; up to 24 hours in advance: 50% of the payable price; less than 24 hours in advance: the total price must be paid.
Modifications: any modification to the details of the visit (timings, content, number of persons, etc.) must be communicated to TN as soon as possible. Consideration will then be given to the modification subject to the availability of the guide and the owner of La Maison Duplain.
Delayed arrival of the group: in case of delayed arrival, it is essential for the customer to warn TN by calling +41 32 889 68 95. Outside of TN’s opening hours, please contact your guide directly. The guide will continue to wait for the group for the first quarter of an hour following the time of the appointment. If the customer is late, the time of the visit will be reduced by a period proportionate to the accumulated delay. If the customer wishes to carry on with the full duration of the visit (subject to the availability of the guide and the owner of La Maison Duplain), he/she must pay an additional inclusive charge.
4. Other provisions
4.1. Data protection
Unless any provisions of these GTCS stipulate otherwise, TN acknowledges the confidential nature of the information and data communicated to it by the contracting party when placing orders / making purchases / making reservations, and undertakes not to disclose such information to third parties other than the enterprises which offer the purchased / reserved services. This information and data is used by TN in order to process orders / purchases / reservations and also for marketing and statistical purposes, with the aim of improving the services offered to the contracting party. The said contracting party has the right to access and rectify his/her/its personal data. In order to exercise these rights, the contracting party shall contact TN, providing proof of identity.
TN accords high importance to data protection. As a visitor to the website, the contracting party decides which personal information he/she/it wishes to share with TN. Whenever the website is visited and whenever the newsletter is read, TN automatically obtains access to information regarding traffic which, however, does not allow attribution to the persons or parties concerned. This information is used solely to establish statistics regarding the use of the website.
4.2. Amendments to the GTCS
TN may amend the GTCS. The version of the GTCS in force when the contract is concluded shall be applicable between the contracting party and TN.
4.3. Governing law and place of jurisdiction
All legal relations between TN and the contracting party are governed by Swiss Law. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is not applicable.
In case of disputes, and subject to legal proceedings initiated by the consumer, the exclusive place of jurisdiction shall be Neuchâtel.
